Court stays shifting of Borivali school

Court seeks undertaking from school management for reconstruction of current building, does not give permission to shift to G.H. Sheth High School unless occupation certificate is obtained

The writ petitions challenging an order by school management granting conditional permission to shift Borivali Education Society’s Matorshri Kashiben Vrujlal Valia International Vidyalaya (MKVV) Borivali (East) to the premises of G H Sheth High School, Borivali (West) passed by the Government of Maharashtra received some relief after hearing the Bombay High Court's reaction.  The petition filed by eight parents on behalf of all the students studying in schools and their parents, challenged the management's decision to shift the school to G H Sheth High School on the condition that the current school building is dilapidated. However, the latter school does not have an occupation certificate to operate above certain floors, making the school not qualified to register under CBSE norms.

"The modus operandi adopted by the Chairman of the Trust along-with others is well workedout and appears to compose of three phases, i.e. MKVVIV is dilapidated unsafe for use, Shifting of the School to G H High School, deliberately flouting the norms of CBSE, and thereby, causing disaffiliation of the school. This is used by politicians and builders often to eat up land space in the clone of development," said Advocate Abhishek Bhat.

"The petition reveals earlier communications between the Management and the CBSE wherein, the Management has time and again approached the Board to grant permission to shift the school from the current premises.

“It is further seen from the contentions raised in the petition that the structural audit of R S Patel High School constructed much before MKVVIV, was placed before this Court only to achieve their ulterior motive of grabbing the property," Bhat added.
