Ryan Trustees interim relief extended, victim’s father files intervention application

The Pintos had filed for anticipatory transit bail before the Bombay High Court after the murder of eight-year-old son at Ryan International School in Gurgaon and the High Court on Tuesday had granted a day's temporary relief to them and posted the matter for further hearing on Wednesday. The father of the murder victim on Wednesday filed an intervention application before the court opposing the pre-arrest bail of the Pintos.

In an interesting development in the hearing of the anticipatory transit bail application of Mumbai-based Ryan International Group's Chairman Augustine Pinto (73) and his wife Grace Pinto (62) – Managing Director of the Group along with their son Ryan Pinto – CEO of the Group, the Bombay High Court on Monday extended the interim protection from arrest to the trio for a day.

This comes as the father of the murder victim filed an intervention application before the court opposing the pre-arrest bail of the Pintos.

The Pintos had filed for anticipatory transit bail before the Bombay High Court after the murder of eight-year-old son at Ryan International School in Gurgaon and the High Court on Tuesday had granted a day's temporary relief to them and posted the matter for further hearing on Wednesday.

During the hearing on Wednesday, Barun Thakur represented by his lawyer advocate Sushil Tekriwal moved the High Court with an intervention application opposing the bail, stating, “We are opposed in strongest possible terms and words as the instant case being a rarest of the rare case where a brutal, diabolical, cold blooded, barbarous, demonic, unpardonable, unprovoked, hellish, cruel homicide has taken place on the campus of Ryan International School.”  

However, Justice Ajay Gadkari asked Thakur's lawyer to serve the copy of the intervention application to senior counsel Niteen Pradhan who is representing the Pintos in their bail plea.

Advocate Tekriwal mentioned the details of the killing of the 7-year-old Pradyuman when the court stated that matter cannot be heard on merits as it does not have the territorial jurisdiction for the case.

Thakur's petition said, “The trustees vicariously responsible, liable, accountable, answerable for the culpability and guilt for which the bail application should be dismissed in limine (at the threshold). The remorseless, spineless and senseless approach and attitude of the school management, its directors, CEO and other top notch executives in this rarest case is absolutely inexcusable and hence, the present bail application deserves to be dismissed in toto. I am shocked by the trustees' statement that they are not part of the crime as they do not look after the day-to-day working of each school. If the top management of the school can share in the plunder and prosperity, why should it not face the rule of law because of vicarious liability.”
