Square Housing Development Corporation, a real estate development firm, is alleged to have forcibly demolished the toilet of a tenant on 23-2-2010, after he refused to surrender his rights to property bearing house No. M/162/1, Ferreira Compound, D’Monte Lane, Orlem, Malad.
Joseph Fernandes, a 71-year-old senior citizen, the tenant who refused to recognize the builder, had many surprises awaiting him.
After the forcible demolition of his toilet, a truck bearing registration No. MH-04-DD-9267, was deliberately reversed, crashing into his house, further damaging it considerably.
Fernandes, who had approached the 34th Small Causes Court at Bandra, obtained a stay on 23-2-2010 itself, stating ‘status quo be maintained till further orders,’ which stay was intimated to the Malad Police station, as well as to the builders. In spite of the stay, the builder commenced cutting trees, and further demolished part of the already deliberately damaged structure on 26-2-2010. This fact was brought to the knowledge of the Malad Police, who preferred to reduce to writing his complaint u/s 155 of the Cr.P.C. when in fact it ought to have been registered u/s 154 of the Cr.P.C.
It is alleged by Fernandes, that the house was further broken on 27-2-2010, and again roof was uprooted on 28-2-2010, when Sr. Inspector Aadav of Malad police station visited the site, but did nothing.
The landlady, Greeta Ferreira, of Chimbai, Bandra, claims to have sold the property, whereas the builders, Square Housing Development Corporation do not possess any authentic documents to establish their title to the property.
One of the partners of the developer’s firm, according to confidential reliable source, is notorious for having built a number of illegal structures in H/West Municipal Ward area comprising Bandra and Khar. In fact, one of the partners threatened this reporter on the premises of the Court itself, to stay clear of this dispute, else serious consequences would follow.
On Saturday, 24-4-2010 and Sunday 25-4-2010, the demolition continued even though phone calls were made to police on 100, who refused to give the complaint number, or address the grievance.
